Brief description:
From 1 December 2019, the formation of new real estate property and the amendment of its composition (except apartment property) from real estate State Cadastre Information System (Cadastre) registered real estate objects shall be proposed in the relevant district (city) court if the new real estate is to be created by merging or splitting the real estate into the Land Register property or building own-initiative building property. In such cases a request for corroboration shall be submitted to a district (city) court, which is addressed to the district (city) court and the State Land Service (VZD).
Only real estate recorded in the Land Register shall be divided or combined. An object of real estate shall be determined or immovable property shall be formed if the changes registered in the Cadastre in the composition of real estate have been entered in the Land Register.
EXCEPTION: This condition shall not apply to land agreed and owned by the State or local government in the cases specified in the regulatory enactments regulating land reform prior to the initial recording of land in the Land Register (in accordance with Section 11, Paragraph two, Clause 1 of the Real Estate State Cadastre Law).
Real estate shall only be formed from such real estate objects, which have been determined in accordance with Section 16 of the Real Estate State Cadastre Law.
If the immovable property to be divided has not been entered in the Land Register or if the objects of immovable property, from which the new immovable property is to be created, have not been entered in the Land Register (except the structure registered in Cadastre, which shall be entered in the Land Register as an own-initiative building property) or have not been registered in the Cadastre or does not conform to the requirements specified in the regulatory enactments regarding regarding regarding the real estate property property recording in the Land Register, the VZD shall first propose registration or updating...
