Brief description:

Within 2 weeks of the date of receipt of the declaration and the documents attached thereto, a decision shall be taken to carry out a proficiency check.

Within 5 working days of the qualification examination, the document certifying the results of the qualification examination shall be sent to the applicant.

If the assessment of the results of the qualification examination is positive, the Certification Centre of the Maritime Union of Latvia shall issue a permit within 1 month from the date of receipt of the declaration and the documents appended thereto.

If the assessment of the results of the qualification examination is negative, the Certification Centre of the Maritime Union of Latvia shall take a decision regarding the refusal to issue a permit within 1 month from the receipt of the declaration and the documents appended thereto.

The time limit for taking a decision may be extended for a period not exceeding 4 months after receipt of the declaration.

1. solis / Submission of documents
A person whose legal status is a Member State of the European Union or a Member State of the European Free Trade Association shall be regarded as a temporary professional service provider in the profession regulated in the Republic of Latvia, if his or her professional activity in the relevant profession in the Republic of Latvia is limited in terms of duration or has an occasional nature.

A provider of temporary professional services, prior to the provision of services in the Republic of Latvia, shall be required to receive a permit of the Latvian Maritime Union Certification Centre for the provision of temporary professional services.

The provider of short-term professional services does not need the recognition of documents certifying education and professional qualifications, but when the first time commencing the provision of temporary professional services in the profession regulated in the Republic of Latvia, the applicant shall notify the Latvian Maritime Union Certification Centre thereof, submitting it personally, sending by mail or electronic means (in conformity with the regulatory enactments regarding the presentation of electronic documents and) the following documents:
declaration of , completed in the official language (Annex 2 to Regulation No 47 of the Cabinet 21.01.2021.)
 a copy of the identity document;
 a copy of the document certifying the nationality of the applicant and the translation of the document into the official language;
 documents attesting to the education and professional qualifications corresponding to the profession indicated in the declaration (originals or certified copies) and the translation of these documents into the official language;
documents (originals) issued by the competent authorities of the State of legal status of the  attesting the right of the applicant to pursue a professional activity in the relevant profession or part of the professional activities of the regulated profession and the translation of these documents into the official language
document issued by the competent authorities of the State of legal status of the  certifying that the person has not been deprived or restricted from the right to pursue a professional activity in a profession in which temporary services will be provided and the translation of this document into the official language
, if the profession or the education required for its acquisition is not regulated in the country of the legal status of the applicant, a document attesting that the applicant has carried out a professional activity in the profession in question in the last 10 years in the country of the legal status of the applicant or in another Member State of the European Union, or in the Member State of the European Free Trade Association, and a translation of this document in the official language.

Documents issued by the competent authorities of the State of legal status, which certify that the person has not been denied or restricted right to perform professional activities, shall be valid for submission to the Certification Centre of the Maritime Union of Latvia for a period of 3 months from the date of their issue.

2. solis / Examination of professional qualifications
The Maritime Certification Centre of Latvia shall examine the declaration of the applicant and the attached documents.
Before issuing an authorisation to provide temporary professional services, it shall have the right to verify the professional qualifications of a short-term professional service provider.

The Certification Centre of the Maritime Union of Latvia shall, within a period of 2 weeks from the date of receipt of the declaration and the documents appended thereto, take a decision to perform a qualification examination if, in comparison with the requirements specified for the relevant profession regulated in the Republic of Latvia, the qualification documents submitted by the applicant have identified the following differences regarding the duration, content and extent of the professional experience acquired by the applicant:
the qualification documents of the  applicant do not certify that educational subjects (study courses) have been acquired, which, in accordance with the requirements specified in the regulatory enactments of the Republic of Latvia, are mandatory for obtaining the relevant professional qualification;
the qualification documents of the  applicant demonstrate that an unregulated educational programme has been completed, the profession concerned is not regulated in the country of the legal status of the applicant and that the applicant has not acquired at least one year of professional experience in that profession in the last 10 years.

The Certification Centre of the Maritime Union of Latvia shall indicate the following information in the decision regarding the examination of qualifications:
the content and extent of the knowledge, skills and competences to be identified in the  proficiency test;
the  authority in the Republic of Latvia in which the applicant may take the qualification test;
procedures for the  of the qualification;
criteria for the assessment of the  qualification;
the place and time of the  proficiency check;
 fee for proficiency testing.
3. solis / Issuance of the permit
The Certification Centre of the Maritime Union of Latvia shall send the document certifying the results of the qualification examination to the applicant within 5 working days after the qualification check.

If the assessment of the results of the qualification examination is positive, the Certification Centre of the Maritime Union of Latvia shall issue a permit within 1 month from the date of receipt of the declaration and the documents appended thereto.

If the assessment of the results of the qualification examination is negative, the Certification Centre of the Maritime Union of Latvia shall take a decision regarding the refusal to issue a permit within 1 month from the receipt of the declaration and the documents appended thereto.

If the provider of short-term professional services has not added all the necessary documents to the declaration or additional information from the State of his or her legal status has to be requested, the Certification Centre of the Maritime Union of Latvia may extend the decision period for a period not exceeding 4 months after receipt of the declaration.

If the Certification Centre of the Maritime Union of Latvia does not notify the decision regarding the issuance of a permit or the refusal to issue a permit within a period of 1 month or notify regarding the extension of the period for the taking of the decision for a period not exceeding 4 months from the date of receipt of the declaration or does not notify the decision after the expiry of the extended term, the applicant may commence the provision of temporary services.
4. solis / Renewal of the declaration
The declaration regarding the provision of short-term professional services shall be renewed at least 1 times a year, provided that the provider of short-term professional services intends to provide temporary professional services on several occasions during that period.

The declaration must be renewed immediately if the information provided therein has changed significantly or changes have occurred in the documents accompanying the declaration.

The re-declaration shall be accompanied only by documents which contain changes to the documents accompanying the previous declaration or which have expired.

If the provider of short-term services has indicated in the declaration that temporary services have been provided in the previous year, the Certification Centre of the Maritime Union of Latvia shall, within 1 month from the date of receipt of the declaration, evaluate whether his or her professional activity conforms to the nature of temporary services in relation to the duration, frequency, regularity and continuity of the provision of services.
